COACHING GUIDELINES

We coach our clients by utilizing questionnaires, asking questions, listening to you, reflecting back what you tell us, identifying your resources, clarifying your values and vision, creating strategies to overcome challenges, and assisting you to determine and realize your dreams and goals. Although there are no guarantees on the outcomes from coaching most people report significant progress on accomplishing their goals.

COACHING IS NOT THERAPY

Although we are trained in psychotherapy and are licensed in Colorado as mental health providers, we do not engage in the practice of psychotherapy with our coaching clients. For example, in coaching, we will not assess for, nor diagnose and treat mental health disorders. Rather, in coaching, we will determine your goals and the strategies you can use to obtain your goals. If issues arise that are best dealt with in a therapeutic context we will refer you to an appropriately licensed psychotherapist.

COACHING APPOINTMENTS

We will agree on a time for your consultations. Once that time is established it will be reserved for you. If you need to cancel a session, please provide at least 24-hour notice or you will be charged for the appointment.

SESSION PAYMENT

Coaching sessions are paid for by the time of service by cash, check or credit card unless otherwise arranged prior to the session. As part of the initial goal setting and resource development, we may recommend you complete additional online assessments, which may require an additional fee. These additional costs will be discussed and agreed to prior to completing the assessments.

CONFIDENTIALITY

Because the coaching relationship may utilize the internet (email, Zoom) and telephone for the transmission of personal information we cannot guarantee the confidentiality of the personal information that you provide via these forms of communication. However, any information that you provide to us will remain confidential and will not be given to a third party unless you give specific permission to release the information, or we are required by law. Exceptions to confidentiality include intent to harm yourself or another individual, child abuse and elder abuse.

CONSUMER SATISFACTION AND LEGAL REMEDIES

We trust that you are satisfied with the coaching services that we provide you and that you experience improvements and positive changes in your life. Because of the complexity of human functioning we cannot guarantee the outcome of the coaching, nor the impact on your life of any changes that you subsequently make.

Each party agrees to indemnify, defend and hold harmless the other party, its agents, officers, and employees from and against any and all liability expenses including any defense costs and legal fees incurred in connection with claims for damages of any nature whatsoever, including but not limited to bodily injury, death, personal injury, or property damage arising from such party's performance or failure to perform its obligations hereunder.

CRISIS MANAGEMENT

Due to the nature of our schedules and availability, we are not available to provide crisis management services. Client agrees to seek support from a third party Mental Health provider such as Mind Springs or Aspen Hope Center for Mental Health Crisis support and treatment and not hold ARI responsible such level of care.

LEGAL INVOLVEMENT AND COURT TESTIMONY

Due to the nature of our work, schedule and commitments, we will not testify in court in support of any client regarding any manner. Client agrees not to subpoena any ARI coach, documentation or record.

Should the client, or any person or agency acting on their behalf subpoena any party associated with Aspen Relationship Institute related to but not limited to records, files or testimony, such act will be considered a violation of this agreement, and client will be responsible for the following:

  1. Payment in full of a fee of $500 per hour for any and all activities stemming from such action included but limited to emails, phone call, copying, completing forms, testifying, and travel.

  2. All administrative fees including copying, printing and mailing

  3. All legal fees incurred by ARI, including but not limited to legal consultation for reviewing documents,

    advising on legality of the subpoena, and preparation for testifying.

  4. All travel expenses including flights, hotels and rental cars as chosen by Aspen Relationship Institute

  5. $1500 per ARI associate for each day of travel and/or spent more than 50 miles from Aspen, CO.

  6. A $2500 deposit is to be made at the time of initiating ARI in legal matters, including but not limited to

    contact from attorneys or delivery of subpoena in person or electronically. ARI will invoice clients directly (not through attorneys or other representation) every 30 days for additional expenses incurred and client agrees to pay each invoice in full within 30 days. If client fees do not meet $2500, clients will be refunded the remainder within 30 days of the court proceedings concluding.

  7. By signing this document, client agrees this contract supersedes any outlined “reasonable and appropriate” fees set by court, or customary in court proceedings.

CLIENT CONSENT FOR COACHING

You understand that Coaching does not fall under the jurisdiction of the state licensing board of Colorado and Federal HIPPA regulations do not apply. You have read and understand the above information. You have freely and willingly signed this contact, with the knowledge and understanding that coaching with ARI is a voluntary process in which you choose to engage.
